Terms of Service
1. Introduction
By downloading or using the VivaVibe app (the "App"), these terms will automatically apply to you—please ensure that you read them carefully before using the App. You are not allowed to copy, modify, or use any part of the App or our trademarks in any way. You are also prohibited from attempting to extract the source code of the App or translating it into other languages or creating derivative versions. The App and all related trademarks, copyrights, database rights, and other intellectual property rights remain the property of Viva Vibe.
2. Changes to the App and Fees
VivaVibe is committed to making the App as useful and efficient as possible. Therefore, we reserve the right to make changes to the App or charge for its services at any time and for any reason. We will never charge you for the App or its services without clearly informing you about what you are paying for.
3. Data Security
Although we do not collect user data, we recommend that you keep your phone and access to the App secure. Therefore, we advise against jailbreaking or rooting your phone, which may expose it to malware/viruses/malicious programs, compromise its security features, and potentially cause the App to function improperly.
4. Network Connection
Certain features of the App require an active internet connection. The connection can be via Wi-Fi or provided by your mobile network provider, but if you do not have access to Wi-Fi or your data allowance is depleted, we cannot be held responsible for the App not functioning properly.
If you use the App outside of a Wi-Fi area, please note that your agreement with your mobile network provider still applies. You may incur charges from your mobile provider for data usage or other third-party charges. By using the App, you accept responsibility for any such charges, including roaming data charges if you use the App outside your home territory (i.e., region or country) without turning off data roaming. If you are not the bill payer for the device you are using, please ensure you have obtained permission from the bill payer to use the App.
5. Device and Battery
Please ensure that your device remains charged. If your device runs out of battery and cannot be turned on to use the service, we do not accept responsibility.
6. Limitation of Liability
While we strive to ensure the App is up-to-date and accurate, we rely on third parties to provide information for the App. Viva Vibe accepts no liability for any direct or indirect loss you experience as a result of relying entirely on the functionality of the App.
7. App Updates
We may update the App from time to time. The App is currently available on iOS, and system requirements (as well as any additional systems we decide to extend availability to) may change. You will need to download updates if you wish to continue using the App. We do not promise to always update the App to keep it relevant to you or compatible with your iOS version. However, you agree to accept updates when offered. We may also choose to discontinue providing the App and terminate its use at any time without notice. Unless we notify you otherwise, upon termination: (a) the rights and licenses granted to you under these terms will end; (b) you must stop using the App and, if necessary, delete it from your device.
8. Changes to This Terms of Service
We may update our Terms of Service from time to time. Therefore, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms of Service on this page.
